Welcome to nudge (“App”), operated by Spark UG (haftungsbeschränkt) (“Company,” “we,” “our,” or “us”). By accessing or using nudge, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use nudge.

2. Eligibility

To use nudge, you must be at least 16 years old or have parental/guardian consent if required by law in your country. By using the App, you confirm that you meet these requirements.

3. User Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account and any activity that occurs under your credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to:

  • Use the App in compliance with all applicable laws and regulations.
  • Respect other users and not engage in harassment, abuse, or harmful conduct.
  • Not use nudge for unauthorized commercial purposes or spam.

We reserve the right to remove content or suspend accounts that violate these guidelines.

5. User-Generated Content

  • You retain ownership of any content (messages, nudges, videos, etc.) you post.
  • By sharing content, you grant nudge a non-exclusive, worldwide, royalty-free license to use, distribute, and display the content in connection with the App.
  • We may remove or moderate content that violates our policies.

6. Privacy & Data Handling

Our collection and use of personal data are governed by our Privacy Policy. By using nudge, you consent to these practices.

7. Third-Party Services

  • nudge may integrate with third-party services such as Google Sign-In, Apple Sign-In, and Firebase.
  • We are not responsible for the policies or actions of these third-party services.

8. Termination & Suspension

We reserve the right to:

  • Terminate or suspend your account if you violate these Terms.
  • Modify or discontinue parts of the App at any time without liability.

9. Disclaimer of Warranties

  • The App is provided “as is” without warranties of any kind.
  • We do not guarantee uninterrupted or error-free operation of the App.
  • We are not responsible for any loss or damage arising from your use of nudge.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages arising from your use of nudge.
  • Our total liability for claims related to the App will not exceed the amount you paid (if any) to use nudge.

11. Changes to These Terms

We may update these Terms from time to time. Users will be notified of significant changes via email or within the App.

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Germany.
  • Any disputes will be resolved in the courts of Germany.
